General Conditions of Sale The offer and sale of products made on the Site www.aziendasabina.it are governed by these General Conditions of Sale. Before sending the purchase Order, Customer is required to carefully read these general conditions of sale. The sending of the Purchase Order implies the full knowledge and express acceptance of both the General Conditions. Object These General Conditions of Sale have as their object the sale of fresh and shelled garlic, performed online through an e-commerce service on the site www.aziendasabina.it. The characteristics of the products and their prices are expressly reported on the website. Subject The products sold on the website www.aziendasabina.it are sold by Organizzazione Produttori Sabina Soc. Coop. Agricola based on Via San Martino, 39 83036 Mirabella Eclano (AV) VAT number IT02842450641, e-mail info@aziendasabina.it General Conditions of Sale relating to the purchase of products online on the website www.aziendasabina.it These General Conditions of Sale are governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the rules on electronic commerce (Legislative Decree no. 70/2003 and subsequent.amendments) and apply exclusively to the online (indirect) sale via the web of all the Products shown on the Site www.aziendasabina.it. These General Conditions of Sale also govern the offer, sending and acceptance of purchase orders for products on www.aziendasabina.it and do not regulate, however, the provision of services or the sale of products by parties other than the Seller that are present on www.aziendasabina.it through links, banners or other hypertext links. Before sending orders and purchasing products and services from parties other than the Seller, we suggest checking their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller. Once these Conditions of Sale have been accepted, the Seller is exempted from any liability arising from the issuance of incorrect tax documents due to errors in the data provided at the time of placing the Order online.Once these Conditions of Sale have been accepted, the Seller is also exempted from any liability deriving from errors or delays in accessing the Website by the customer at the time of entering their data in the purchase procedure. As well as from the slowness or impossibility of receiving the confirmation of the customer’s Order or from any anomaly that may occur due to problems with the server, or due to any other event (also inherent to the e-mail address provided by the customer) not foreseeable and independent of O.P. Sabina Soc. Coop. Agricola. The Customer undertakes, once the planned purchase procedure has been completed, to provide for the printing and storage of these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the sending phase of the order. This is in order to fully satisfy the condition of art. 53 of Legislative Decree no. 206 of 06/09/2005. It is forbidden for the Customer to enter false, and / or invented, and / or fantasy data in the registration procedure necessary to activate the procedure for the execution of this contract and the related further communications; the personal data and the e-mail must be exclusively your real personal data and not of third parties, or fantasy. It is expressly forbidden to place false cash on delivery orders. In this case, a complaint will be made to the postal police and the IP address from which the order was received will be provided to the authorities. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties.It is also forbidden for minors to make registrations on the Site www.aziendasabina.it except with the consent of their parents or their legal guardian.  By placing an order through this Website, you warrant that you are of legal age (18 years) and have the legal capacity to enter into binding contracts. Contract of Sale through e-commerce service The Online Purchase Contract is the Distance Contract that provides for the sale of movable property stipulated between the Customer and O.P. Sabina Soc. Coop. Agricola, as part of an e-commerce service organized by the Seller who, for this purpose, uses the remote communication technology called the Internet. The conclusion of the Contract of one or more Products is represented by the sending of the Order form in electronic format and transmitting it to the Seller via the Internet following the relative instructions. The following contents are contained in the Order form:
  • reference to these General Conditions of Sale;
  • the name of the products purchased and the relative price (on the previous page, the cart, the images and links to the products included in it are also shown);
  • the method of payment that the Customer can use;the methods of delivery of the Products purchased, the times and the related shipping and delivery costs;
  • the reference to the conditions for the exercise of your right of withdrawal;
  • the methods and times of return of the products purchased.
Although the photographs shown on the Site are faithful reproductions of the original products, even using every possible technological solution in order to minimize inaccuracies, any presence of variations due to the technical characteristics and color resolution characteristics that the computer displays are not excluded. As a result, O.P. Sabina Soc. Coop. Agricola will not be responsible for any inadequacy of the graphic representations of products shown on the Site if due to the aforementioned technical reasons, since these representations have a merely illustrative function. Once the purchase of one or more products has been completed, O.P. Sabina Soc. Coop. Agricola (hereinafter referred to as Seller) will take charge of the order and send the customer an Order Confirmation to the e-mail address provided by the Customer during registration or purchase, in which the following contents will be summarized:
  • ORDER CONFIRMATION;
  • Products and Services chosen and their prices (including shipping costs and any additional costs requested by the customer, applicable to each individual Order);
  • General Conditions of Sale.
The Seller reminds the Customer to verify with the utmost attention and care the correctness of the data contained in the Order Confirmation and to communicate to O.P. Sabina Soc. Coop. Agricola within 30 minutes of receiving any corrections. The Order Number, generated by the system and sent by O.P. Sabina Soc. Coop. Agricola must be used by the Customer in any communication with O.P. Sabina Soc. Coop. Agricola. It is possible that occasionally there may be unavailability of the Products offered; in this case, if the Products chosen by the Customer are not, in whole or in part, available, the Seller will communicate it to the Customer. If one or more Products ordered by the Customer are not available, even after the order confirmation has been sent, O.P. Sabina Soc. Coop. Agricola will not consider the Purchase Contract concluded, and therefore the amount of money previously committed will be fully refunded. The Seller undertakes to deliver the ordered products to the Customer no later than 30 days from the date of conclusion of the Contract. The language available to conclude the Contract with the Seller is Italian and the applicable law is Italian. O.P. Sabina Soc. Coop. Agricola reserves the right to refuse orders from a Customer with whom a legal dispute is in progress relating to a previous Order. O.P. Sabina Soc. Coop. Agricola reserves the right to refuse orders from a Customer for any other legitimate reason, especially if the customer has been involved in fraudulent activities of any kind. Sales Prices All prices of the Products and shipping and delivery costs on www.aziendasabina.it are to be understood as VAT INCLUDED, except for other indications. The currency used on the Site is the Euro. The shipping and delivery prices are those indicated on the site, except for any costs related to customs duties and any taxes, which are not previously calculable, as in the case of extra-EU shipping, where current legislation may provide for import charges. In this case, these expenses will be reworked and clearly mentioned during the revision and reinstatement of the Order. It is possible that both the prices of the Products and the shipping prices may vary over time, therefore, if one or more items are inserted in the Cart and returned to the Site later, it is advisable that the Customer checks these prices again, before completing the purchase procedure. In case of non-collection, the Seller will refund the cost of the product but not also the shipping costs, exit and entry costs related to customs duties and related taxes and shipping costs for shipping the product to the seller. All costs included in the Order Confirmation (prices of one or more products, shipping costs, costs of additional services requested by the Customer) are fully borne by the Customer. Requirements To purchase products on the site you can register as a user, entering personal data and data for shipments, to have a password to access the private area. Once the authorization to access the private area has been obtained, the Customer has all the services related to the latter available. It is also possible to make the purchase as a guest without registering on the website. Accepted payment methods The O.P. Sabina Soc. Coop. Agricola on its website allows payments in the following ways:
  • Credit, debit or prepaid card
  • PayPal
  • Bank transfer
In case of payment by credit, debit or prepaid card, the customer must enter, independently, the 16-digit PAN, the CVV security code, the expiration date and the name and surname of the holder. Payment is made in automatic mode. Depending on the bank issuing the card, a security check (e.g. OTP on your mobile phone) may be required. In case of payment by PayPal the customer is automatically redirected to the paypal.com website to complete the order, where he will have to enter the credentials of his account. In case of payment by bank transfer after clicking on “place order” an order number will be assigned. It is necessary to enter this number in the reason for the bank transfer. The transfer must be made within 3 days and a copy of the accounting must be sent to info@aziendasabina.it The order will be processed after accounting. In case of non-receipt of the accounting within 3 working days the order will be canceled. The transfer must be made to the following IBAN: IT72O0855375771003000309964 payable to: O.P. Sabina Soc. Coop. Agricultural. Shipping and Delivery SHIPPING BY EXPRESS COURIER ON THE NATIONAL TERRITORY Throughout the Italian territory, islands and remote areas included, shipments are FREE for orders from 49.00 euros. For orders of a lower amount the cost of shipping is equal to 6.90 EURO. On the Italian territory shipments are entrusted to the following couriers

  • DHL
  • UPS
  • GLS
The choice of the courier is at the discretion of the O.P. Sabina Soc. Coop. Agricultural. The shipment is of the EXPRESS type. When the package is entrusted to the courier, the customer receives an email with the link to track the shipment. All shipments are traceable. Returns and refunds Pursuant to art. 52 of Legislative Decree 206/05, the Consumer may return the products purchased, without having to provide any reason and without penalty, within 14 (fourteen) days of receipt of the same by the carrier. The Customer who intends to exercise the right of withdrawal must send, within the aforementioned period of 14 (fourteen) days, an explicit declaration to this effect, to which he must attach a copy of the email received during the order and order number. This communication may be sent, by e-mail, to the following e-mail address: info@aziendasabina.it The O.P. Sabina Soc. Coop. Agricola will examine the refund procedure and will send the customer, within 3 days, the waybill to be applied on the package (or on the packages if multi-neck). The O.P. Sabina Soc. Coop. will book the collection of the package at the shipping address by the first useful working date. The customer may communicate, in any case, an alternative collection address and a date of collection of the preferential goods. The collection is carried out exclusively by courier made available by O.P. Sabina Soc. Coop. at a cost of Euro 6,90. This cost is deducted from the amount returned. The O.P. Sabina Soc. Coop. Agricola will refund the price of the returned product on the means of payment chosen by the customer during the purchase. In case of payment made by credit card or PayPal, the customer will receive the refund directly on the payment method used; on the contrary, in case of payment made by bank transfer or cash on delivery, the customer must provide the bank details (IBAN) necessary for the refund. The refund will be made after receiving and evaluating the status of the goods sent as return. The goods must be received intact (the packages must not be damaged, for example, to the labeling). From receipt of the goods the refund is processed in 7 working days. ONLINE DISPUTE RESOLUTIONI If you have submitted to us a problem that we have not been able to solve together, remember that since January 9, 2016 the law makes available to you the online resolution service of consumer disputes. Agricola is always available to seek an amicable solution to the disputes that have arisen, also through the direct contacts indicated, the Customer is informed that, according to Article 14 of EU Regulation no. 524/2013 and the resolution on the ODR referred to in the Statutory Instrument n. 500/2015 in force since 15 February 2016, an online platform has been established by the European Commission for the resolution of ODR disputes (“online dispute resolution”) derived from the purchase of  online goods accessible at the following link: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage Through the ODR platform, the Customer will be able to consult the list of ODR entities, find the link to each of them and initiate an online dispute resolution procedure.
